Judge sets bail at $2 million in PB condo murder case

A preliminary hearing was set for June 16 for a man suspected of shooting another man inside a Pacific Beach condominium on Jan. 26.

Attorney Marc Carlos is the new attorney for Richard Herrman, 33, who has pleaded not guilty to murdering Gabriel Fergus, 51, in a condominium in the 1600 block of Chalcedony Street.

Carlos appeared for Herrman on April 16 and motioned for bail, as Herrman has been held without bail since his arrest in January. The attorney said Herrman posed no danger to the community.

“He was in his bedroom when the violence came to him,” said Carlos. “All of his ties are in San Diego.”

Deputy District Attorney Gabriella DiCaprio suggested setting a $10 million bail, saying, “He has access to a large trust… and he poses great danger.”

San Diego Superior Court Judge Euketa Oliver set bail at $2 million. Herrman remains in the Rocky Mountain Detention Facility.

Police received a call at 10:15 p.m. saying there was a violent argument occurring inside the condominium and two men were fighting. The call was updated to say someone had been shot.

Both men knew each other and police said both men have previously lived or stayed at the condo. Officers and paramedics rendered aid, but Fergus was pronounced deceased at the scene.

Herrman is also charged with possession of a firearm by a felon and possession of ammunition despite being prohibited from possessing it.
